 PMPA DECISION
On March 2, 2010, the Supreme Court determined that a franchisee cannot file suit under the Petroleum Marketing Practices Act (“PMPA”) for constructive termination if it signed up for a renewal of its franchise.  In the case, Mac’s Shell Service v. Shell Oil Products, the Court considered under what circumstances a service station operator could bring suit against an oil refiner or distributor for “constructive termination” under the PMPA.  Several gas station franchisees filed a lawsuit alleging that the franchisor had constructively terminated their franchises and constructively failed to renew their relationships by modifying the terms of their lease agreements. Essentially, the franchisees were arguing that the terms of the franchise agreement had changed so radically when terms were renewed, the original agreement was constructively terminated.  But the Court decided that if you sign up for another term, you haven’t been terminated, even if the terms of the agreement have changed.

 MORE PUSHBACK ON EPA’S GREENHOUSE GAS RULING
Companion bills were introduced in both the House and Senate on March 4 by coal-state Democrats. The measures would bar the Environmental Protection Agency from regulating greenhouse gas emissions from power plants and other stationary sources for two years. Sen. Jay Rockefeller (D-WV.) introduced his bill (S. 3072) in the Senate, and Reps. Nick Rahall (D-WV), Alan Mollohan (D-WV), and Rep. Rick Boucher (D-VA) unveiled a companion measure in the House. This comes on the heels of a resolution put forth by Senator Lisa Murkowski (R-AK) and forty other cosponsors to disapprove of and prohibit EPA’s current plan to regulate greenhouse gases through the Clean Air Act.

 HOUSE PASSES JOBS BILL
On March 4, the House approved a job-creation bill that extends surface transportation programs through the year, shores up the depleted Highway Trust Fund, and expands a popular infrastructure bond program. The House-passed bill was scaled back from a much larger measure in the Senate in an effort to speed it through Congress. You’ll recall that last week, the Senate passed a larger version of the House bill, a $15 billion package that would give payroll tax relief for businesses that hire unemployed workers. It also would extend the Highway Trust Fund, the “Build America” bond program and expense deductions for small businesses. The House revisions mean the measure will have to be reconsidered by the Senate.  The Senate is expected to take up the legislation (H.R. 2847) after it completes work on a package of tax policy extensions (H.R. 4213).

 BIODIESEL TAX CREDIT
Earlier this week, Senate Majority Leader Harry Reid (D-NV) and Finance Committee Chairman Max Baucus (D-MT) introduced Jobs Bill II (H.R. 4213). In the bill, the one dollar per gallon biodiesel blender’s tax credit was included in the tax extender package. The biodiesel tax credit expired December 31, 2009. Congress will likely take action on the measure next week.

 DEMOCRATS READY TO MOVE HEALTHCARE
Congressional Democrats are completing a revision of comprehensive health care legislation that could garner enough votes to pass both chambers — most likely through expedited budget reconciliation procedures. This type of legislation would only require a simple majority of votes, fifty-one in the Senate and 2/3 of the House. Democrats were working on revised language that was being written jointly by House and Senate lawmakers and White House officials, but it is not yet clear what the final legislation will include.  House leaders aim to bring a final healthcare measure to the floor for a vote before Congress adjourns for its two-week spring recess, which begins March 26.

JOBS BILL PASSAGE IN HOUSE UNCERTAIN
Earlier this week, the Senate passed a $15 billion jobs bill that would give payroll tax relief for businesses that hire unemployed workers. It also would extend the Highway Trust Fund, the “Build America” bond program and expense deductions for small businesses.  The Senate sent the measure for vote in the House where its chances of passage remain uncertain.  Last December, the House passed a massive version of the bill with a total cost of $154 billion dollar.  Many House liberals prefer the larger approach and are decrying the scaled down Senate product.  There is also an argument over highway spending.  Some lawmakers say only a few states would benefit from the Senate bill’s transportation provisions. Late Thursday, Transportation and Infrastructure Chairman James L. Oberstar (D-MN) proposed an alternative plan he said was more equitable among the states. Dissatisfaction with funding and other provisions have forced House leadership to scramble, but they hope to resolve the matters today.  As a back-up measure, the House passed another short-term extension (HR 4691) of numerous programs, including those for surface transportation, on Thursday. It would expire March 28.

 HEALTHCARE GOES NOWHERE
President Obama and congressional Democrats and Republicans debated health care reform for more than six hours Feb. 25, but as expected, the meeting did not bring the parties closer to an agreement on reform legislation. Without a bipartisan agreement, Democrats must decide how to finish work on reform legislation, including whether to use the budget reconciliation process in which only a simple majority vote would be needed to clear legislation in the Senate. That means Democrats will blend the massive House of Representatives bill (cost: $1 trillion), the lengthy Senate version (cost: $890 billion) and the White House plan announced Monday (cost: $1 trillion) and bypass possible procedural roadblocks to pass legislation solely with Democratic votes. Obama ended the session yesterday by saying Democrats and Republicans likely could agree on several reform issues, and he called on Republicans to provide solutions over the next month to six weeks on how to extend coverage to more Americans than under the House Republican bill. The President also rejected calls by Republicans to start over and craft an incremental bill, saying “baby steps don’t get you to the place where you need to go.”

 EPA WILL NOT REGULATE STATIONARY SOURCES THIS YEAR
According to Lisa Jackson, Administrator of the Environmental Protection Agency, the agency will not regulate any power plants or other major stationary sources this year for their greenhouse gas emissions. But the agency will begin issuing permits to these major emitters starting next year. Jackson expects that EPA will phase-in these permit requirements and regulation of greenhouse gases for larger stationary sources starting next year and that between the second half of next year and 2013, the permitting threshold will be “substantially higher than the 25,000-ton limit that EPA originally proposed.” EPA does not intend, she added, to subject the smallest sources to Clean Air Act permits for greenhouse gases any sooner than 2016. Jackson added that the impact of an effort by Lisa Murkowski (R-AK) and others to offer a resolution to strip EPA’s ability to regulate greenhouse gas emissions “would be significant.”

MORE CHALLENGES TO EPA RULING

As you know, EPA announced a finding in December that greenhouse gas emissions endanger public health and welfare and that cars and light trucks cause or contribute to the emissions. As a result, EPA intends to begin regulating greenhouse gas emissions as early as March.  More challenges to the finding came this week as twelve House Republicans and 17 associations and companies filed a lawsuit in federal appeals court challenging the finding (Linder v. EPA). The lawsuit was filed in the U.S. Court of Appeals for the District of Columbia Circuit on February 10 by the Southeastern Legal Foundation on behalf of the members of Congress and the organizations. The Atlanta-based foundation filed a petition for reconsideration of the finding with EPA in December and is filing a supplemental petition that, according to the foundation, includes disclosures of scientific errors and fraud in the finding. This lawsuit comes on the heels of a House bill introduced last week that aims to amend the Clean Air Act to make clear it does not allow for regulation of greenhouse gases as it relates to global climate change.  It would also amend the 2007 Energy Bill to stop EPA from calculating land use changes in foreign countries in the implementation of the renewable fuel program, and would seek to help the biofuels industry by broadening the definition of renewable biomass.

 

JOBS BILL ON TAP AFTER PRESIDENTS’ DAY RECESS

Senate Democrats stripped extensions of several energy tax incentives from their first jobs bill hoping a narrower package will move more quickly. The package is now made up of four parts: a one-year extension of the current highway and transit law; Build America Bonds, which make it easier for state governments to borrow money for public works projects; tax credits for employers who hire new workers; and a provision to allow small businesses to write off the cost of some capital investments. It is unclear whether Republicans will latch on to this proposal, which does not include extensions of tax breaks, a promise to debate the estate tax or other items they have been advocating. The House passed a roughly $150 billion jobs package in December. The jobs legislation will be one of the first items on tap when lawmakers return to work the week of February 22.

 

DEMOCRATS ANNOUNCE NEW PROPOSALS TO REGULATE CAMPAIGN SPENDING

This week, Democrats announced a sweeping new set of proposals to regulate campaign spending by corporations, unions, and other entities. Sen. Charles E. Schumer (D-NY) and Rep. Chris Van Hollen (D-MD) outlined a broad response to a Supreme Court ruling last month that held corporations cannot be barred from direct spending around elections. They intend to introduce legislation in the House and Senate during the week of February 22, with the goal of enacting it before the midterm elections in November. The two lawmakers are proposing a ban on expenditures by foreign-controlled corporations. They also want to bar direct expenditures by corporations that have received funds through the Troubled Asset Relief Program until after those funds are repaid, and bar election-related spending by federal contractors. Other proposals include new rules for disclosure of election-related spending, both to the government and to shareholders; new disclosure requirements for campaign expenditures by registered lobbyists; and requirements that CEOs appear in the broadcast ads funded by their corporations and attest to them in the same manner that candidates must endorse their own ads under existing federal election law.
